Company, Coach & Client Agreement
This agreement is only applicable to clients that have purchased a program with Move Private Fitness Studio Sdn Bhd & its branches.
Coach-Client Agreement
Context on Coach-Client Agreement: We believe that in order to achieve the desired results that have been discussed by the coach & client, both parties will need to focus, commit and prioritize. Hence, this agreement is a reminder of our commitment towards the breakthrough journey and desire to respect each other’s time so that it can be an enjoyable & fulfilling journey for both parties.
- High Care & High Challenge: Our coaches are here to serve you and we aim to develop a great friendship with you. However, we will not neglect our priority role as a coach. We become a good coach by empowering you to achieve fulfilling breakthrough journeys through both high care & high challenge. This means that you will receive care such as guidance, encouragement, praise, reviews, goal-celebrations and the like from our coaches. You will also receive challenges such as setting goals, accountability, a push, confrontations and the like from our coaches. Ultimately, both high care and high challenge will be used to help you to take back control and ownership of your health and wellness. Which will then help you live out the purpose of your life even more, by adding value to the people around you.
- Length of sessions and appointment times: Most training sessions are based on a 45-60 minute duration. To get the most out of our efforts, please be ready to exercise at the appointed time. If you are more than 15 minutes late for a scheduled session, it will be considered a no-show and you will be charged. You will also be challenged by your coach if you are more than 1 time late for your session as it can sabotage your breakthrough journey. If the coach is more than 1 minute late for a scheduled session, you will be given an extra session to be completed by the amount of period you’ve signed up for. - Expiration of sessions: This duration of commitment to this investment is according to the program option selected. If you fail to complete the scheduled sessions by the amount of period you’ve signed up for, you understand your training sessions will expire and you are responsible to pay any remaining balance of your account (if any).
- Cancellation Policy: All sessions are arranged on a scheduled appointment basis. In order for effective use of time, all clients are asked to give a 24-hour notice when canceling an appointment. This means a cancellation should be made at least 24 hours before the scheduled appointment by calling/messaging the coach. Personal training sessions canceled within 24 hours of the scheduled appointment will be billed at the normal rate of a single session and deducted from your account.
- Options for replacement (3 options) / extension of sessions:
- Replace sessions 1 week before or 1 week after: Training sessions can only be replaced in the same week or the following week only if 24-hour notice is given. A specific date and time must be given by the client for replacement and discussed with the coach. The coach will only replace the class in this matter if he/she has availability, if not, he/she will have to choose the other options to replace the class.
- Replacement through online sessions: It’s best to keep the consistency of training sessions, hence, the next option is to do online sessions through a virtual platform (eg. Google Meet) when a client is away for holiday.
- Replacement through substitute of coaches (regardless of tier): Client may replace a session with other trainers to keep consistency of the program. Your program will be communicated to the substitute coach with “additional flavors” added if relevant.
- *Extension of sessions: 1 on 1 or 1 on 2 (only if both clients are away) Personal Training clients have the privilege to extend expiry dates if they go for a holiday for more than 7 days. A maximum extension is 4 weeks with a maximum freeze of 2 times. This only applies to programs with 50 sessions and above.
- *Other Note: Replacement/extension of sessions does not apply to semi-private/projects as the training sessions are carried out on a fixed schedule and cannot be changed.
- Exceptions: We understand that there are times when “life throws us a curveball” and we would like to care for your needs as well. Hence, please let us know if there’s any exception that comes with the demands of your life and the coach will suggest a potential solution for you to work with us.
Company-Client Agreement
- Billing agreement: All programs are billed on a Pre-pay basis & are not refundable.
- For installment payments, the next payment will be due 1 month from the date of the first payment. Failure to pay on time will result in remaining sessions being forfeited.
- Substitute of coaches: A substitute coach (Regardless of tier) will take over the session if: A) the original coach is on holiday, B) the original coach having an unfortunate event, C) the original coach is no longer working with the company.
- Release of results upon program completion & photo: Client photos and testimonials are requested upon initial program completion. If we capture any media footage(s) of you during sessions, the company is allowed to use the media footage(s) for promotion purposes.
- Use of nutritional supplements: Any usage of nutritional supplements, drugs, or medication is taken at the client’s own risk and the company is not liable for any consequences that are a result of it. Clients understand that the nutritional guidance provided by the coaches serves as personal guidance & will not be responsible for any medical conditions involved.
- Medical advice disclaimer: Any information, program or recommendation provided by the company and its coaches is not medical advice. Any information, including but not limited to verbal recommendations, program, text, graphics, images and other material provided by the company and its coaches are for informational purposes only. No recommendation, program or material by the company and its coaches is intended to be a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition or treatment and before undertaking a new health care regimen, and never disregard professional medical advice or delay in seeking it.
- Movement Control Order (MCO): If MCO is implemented by the government, classes will be conducted online by means of an online platform. Therefore, there will not be any package freezing options nor refund as stated in the clause above. However, if you have a freeze option in your membership, you can use that option during this time.
- Notification of remaining sessions: An automated email will be sent during the initial sign up of the membership. You can use the login details in the email to track your available sessions. The coach will also track the amount of sessions completed through the system and you would get the update from there. This is optional as some clients prefer to trust the coaches to track the sessions. There will also be another automated email sent to you 5 sessions before your program finishes, hence, you can make plans to renew your program if you wish to. If you do not receive the email, please check with your coach and we can resend the email.
- Trainer Tiers: In MOVE, we highly value continuous learning as that mindset in itself allows us to constantly add more value as we go. Hence, we have a tier system from Junior to Master coach to encourage this mindset and each tiers are priced accordingly. In the case where a coach moves up a tier and the client does not want to increase their budget for their training package, here are 2 more suggestions that we will provide that can still help the client achieve his/her desired outcome:
- Suggest another suitable coach for the client.
- Suggest another suitable training package for our client.
- The client understands and acknowledges the many inherent risks that they may be exposed to from the training and programs held by The Company. The client agrees to waive and release The Company from any responsibility, liabilities, demands, or claims of any kind arising out the client’s participation in The Company’s training, programs and/or events.
- Memberships are transferable but not towards client’s that have an active membership.
PAR-Q & YOU
The PAR-Q will tell you if you should check with your doctor before you start. If you are over 69 years of age, and you are not used to being very active, check with your doctor. Common sense is your best guide when you answer these questions. Please read the questions carefully and answer each one honestly: check YES or NO.
- Your doctor never said that you have a heart condition and that you should only do physical activity recommended by a doctor.
- You don’t feel pain in your chest when you do physical activity.
- In the past month, you did not have chest pain when you were not doing physical activity.
- You don’t lose your balance because of dizziness or you don’t ever lose consciousness.
- You don’t have a bone, joint problem (for example, back, knee or hip) or pain radiating from any part of the body that could be made worse by a change in your physical activity.
- Your doctor or physician currently is not prescribing drugs or medication for your blood pressure or heart condition.
- You don’t know of any other reason why you should not do physical activity.
If you honestly agreed to all the statements above, you can be reasonably sure that you can:
- Start becoming much more physically active – begin slowly and build up gradually. This is the safest and easiest way to go.
- Take part in a fitness appraisal – this is an excellent way to determine your basic fitness so that you can plan the best way for you to live actively. It is also highly recommended that you have your blood pressure evaluated. If your baseline reading is over 144/94, talk with your doctor before you start becoming much more physically active.
If you do not agree with any of the statement above:
- Talk with your doctor by phone or in person BEFORE you start becoming much more physically active or BEFORE you have a fitness appraisal.
- Tell your doctor about the PAR-Q and which questions you answered NO.
- Talk with your doctor about the kinds of activities you wish to participate in and communicate with the trainer.
